1. About These Terms

These Terms & Conditions ("Terms") apply to your use of the FitnessFuelCo website at fitnessfuelco.com (the "Website") and to purchases made through the Website.

The Website is operated by FitnessFuelCo ("FitnessFuelCo", "we", "us" or "our").

By using the Website or placing an order with us, you agree to these Terms.

If you do not agree with these Terms, please do not use the Website or place an order.

These Terms should be read together with our:

  • Privacy Policy; and
  • Returns & Refunds Policy.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law (ACL) or any other law that cannot legally be excluded, restricted or modified.

Our online store is hosted by Shopify.


2. Use of the Website

You agree to use the Website lawfully and in a manner that does not:

  • breach any applicable law or regulation;
  • infringe the intellectual property rights of FitnessFuelCo or another person;
  • interfere with the operation or security of the Website;
  • introduce malicious code, viruses or other harmful material;
  • attempt to gain unauthorised access to our systems or accounts;
  • submit false or misleading information; or
  • use the Website for fraudulent or unlawful purposes.

If you breach these Terms, we may restrict or suspend your access to the Website where reasonably necessary.


3. Age Requirements

You must be legally capable of entering into a contract to make a purchase from FitnessFuelCo.

If you are under the applicable age of majority, you should only use the Website and make purchases with the involvement and consent of a parent or legal guardian.


4. Products and Product Information

We make reasonable efforts to ensure that product descriptions, specifications, images and other information displayed on the Website are accurate and current.

However:

  • product colours may appear differently depending on your device or screen;
  • product images may be illustrative and may differ slightly from the actual product;
  • product specifications may change where a manufacturer or supplier updates a product; and
  • availability may change without notice.

These matters do not affect your rights under the Australian Consumer Law.

Where a product description or representation is inaccurate or a product does not match its description, your rights under the ACL continue to apply.


5. Prices

Unless otherwise stated, prices displayed on the Website are in Australian dollars (AUD).

Where applicable, prices include GST.

Shipping and delivery charges, if applicable, will be displayed at checkout before you complete your purchase.

We may change prices from time to time. A price change will not affect an order that we have already accepted, except where an order needs to be cancelled because of an obvious pricing or listing error or another legitimate reason permitted by law.


6. Orders

When you place an order through the Website, you are making an offer to purchase the products selected by you.

After receiving your order, we may send an order confirmation acknowledging that we have received your order.

An order is not necessarily accepted merely because you receive an automated order confirmation.

We may need to cancel or decline an order in limited circumstances, including where:

  • a product is unavailable;
  • there is an obvious pricing or listing error;
  • we reasonably suspect fraudulent or unlawful activity;
  • there has been an error in the order;
  • we are unable to fulfil the order; or
  • cancellation is otherwise permitted by law.

If we cancel an order after you have paid, we will provide an appropriate refund of amounts paid for the cancelled order.

Nothing in this section limits your rights under the ACL.


7. Payment

Payment must be made using an available payment method displayed at checkout.

We may use third-party payment providers, including Stripe and PayPal, to process payments.

You authorize the applicable payment provider to process payment for the amount shown at checkout.

You must provide accurate and complete billing and payment information.

If payment is unsuccessful, we may be unable to process or fulfil your order until payment has been successfully received.


8. Delivery

We arrange delivery using third-party delivery and fulfilment providers.

Estimated delivery times are provided as a guide only unless we expressly state otherwise.

Delivery times may be affected by factors outside our reasonable control, including:

  • courier delays;
  • weather;
  • natural disasters;
  • transport disruptions;
  • incorrect or incomplete delivery information;
  • customs or border delays where applicable; and
  • other events outside our reasonable control.

You are responsible for providing an accurate delivery address.

If an order is returned to us because an incorrect or incomplete delivery address was provided, additional delivery costs may apply before we resend the order, where permitted by law.

We will take reasonable steps to assist you in locating delayed or missing deliveries.

Nothing in this section limits any rights or remedies you may have under the ACL.


9. Risk and Responsibility for Delivered Products

For products purchased by consumers, we remain responsible for the goods in accordance with the Australian Consumer Law.

We do not exclude or transfer your statutory rights by stating that risk passes to you when a courier takes possession of an order.

If your order arrives damaged, faulty, unsafe or not as described, please contact us as soon as reasonably practicable so that we can assist you with the appropriate remedy.


10. Australian Consumer Law

Our products come with consumer guarantees under the Australian Consumer Law that cannot be excluded.

Depending on the circumstances, these guarantees include that goods:

  • are of acceptable quality;
  • are reasonably fit for any purpose that you have made known to us;
  • match their description;
  • match any sample or demonstration model where applicable; and
  • satisfy other applicable consumer guarantees under the ACL.

If a product does not meet a consumer guarantee, you may be entitled to a remedy.

Where a product has a major failure, you may generally be entitled to choose between a refund and replacement, as well as any other remedies available under the ACL.

Where a failure is not major, we may generally have the right to provide an appropriate remedy such as repair or replacement within a reasonable time, subject to the ACL.

These rights apply regardless of any separate change-of-mind returns policy.

Nothing in these Terms, our Returns & Refunds Policy, or any other policy is intended to exclude, restrict or modify your rights under the Australian Consumer Law.


11. Returns, Refunds and Change of Mind

Our Returns & Refunds Policy explains our voluntary change-of-mind return arrangements and the process for requesting a return, refund or exchange.

Our change-of-mind policy does not limit or replace your rights under the Australian Consumer Law.

If a product is faulty, unsafe, not of acceptable quality, does not match its description, or otherwise fails to meet an applicable consumer guarantee, you may have rights to a remedy regardless of whether the change-of-mind return period has expired.

12. Product Safety and Proper Use

You are responsible for using products in accordance with the manufacturer's instructions, warnings and recommended use.

You should read and follow any safety instructions supplied with a product before using it.

Where appropriate, seek professional advice before undertaking exercise or using fitness equipment, particularly if you have an existing medical condition, injury or other health concern.

Nothing in this section limits any rights you may have under the ACL.


13. Website Availability

We aim to keep the Website available and functioning properly, but we cannot guarantee that it will always be:

  • available;
  • uninterrupted;
  • error-free;
  • secure; or
  • free from viruses or other harmful components.

We may temporarily suspend or modify the Website where reasonably necessary for maintenance, security, upgrades or other operational reasons.

Nothing in this section excludes liability that cannot legally be excluded.


14. Intellectual Property

Unless otherwise stated, the content of the Website, including:

  • text;
  • photographs;
  • graphics;
  • logos;
  • product descriptions;
  • designs;
  • page layouts;
  • branding; and
  • other materials

is owned by or licensed to FitnessFuelCo and is protected by applicable intellectual property laws.

You may access and use the Website for your personal, non-commercial use.

You must not reproduce, copy, modify, distribute, publish, sell or commercially exploit our Website content without our written permission, except where permitted by law.


15. Reviews, Feedback and User Content

If you submit a review, comment, photograph, testimonial, suggestion or other content to FitnessFuelCo ("User Content"), you remain responsible for that content.

By submitting User Content, you grant FitnessFuelCo a non-exclusive, worldwide, royalty-free license to use, reproduce, display and publish that content for purposes connected with operating, promoting and marketing FitnessFuelCo.

This license does not transfer ownership of your User Content to us.

You represent that:

  • you have the right to submit the User Content;
  • the User Content does not infringe another person's rights;
  • the User Content is not unlawful or fraudulent; and
  • the User Content does not contain malicious code.

We may remove or decline to publish User Content that we reasonably consider inappropriate, unlawful, misleading, defamatory, offensive or otherwise inconsistent with our Website.


16. Third-Party Services and Links

The Website may use or link to third-party services, websites and platforms.

These may include payment providers, analytics services, advertising platforms, shipping providers and other third-party services.

Third-party services operate under their own terms and privacy policies.

We are not responsible for the content, availability, security or privacy practices of third-party websites or services that we do not control.

This does not affect any rights you may have against FitnessFuelCo under applicable law.


17. Errors and Corrections

We take reasonable care when preparing information on the Website.

However, the Website may occasionally contain typographical, technical, pricing, product or other errors.

Where we identify an error, we may correct the information.

If an obvious error affects an order you have placed, we may contact you to discuss the issue or cancel the affected order where permitted by law.

If an order is cancelled after payment because of an error, we will refund amounts paid for the cancelled order.

Nothing in this section limits your rights under the ACL.


18. Prohibited Conduct

You must not use the Website to:

  • engage in unlawful activity;
  • infringe intellectual property rights;
  • submit fraudulent or misleading information;
  • transmit viruses, malware or harmful code;
  • interfere with Website security or functionality;
  • attempt to gain unauthorised access to our systems;
  • scrape or systematically copy Website content without permission;
  • harass, threaten or abuse our staff or other users; or
  • otherwise misuse the Website.

We may take reasonable steps to protect our Website, staff, customers and business from prohibited conduct.


19. Limitation of Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot legally be excluded, restricted or modified under the Australian Consumer Law or other applicable law.

To the maximum extent permitted by law, FitnessFuelCo will not be liable for loss or damage that:

  • was not reasonably foreseeable;
  • was caused by circumstances outside our reasonable control; or
  • results from your misuse of a product contrary to applicable instructions or warnings,

except where such liability cannot legally be excluded.

Nothing in these Terms limits liability for matters that cannot lawfully be limited or excluded.


20. Indemnity

To the extent permitted by law, you agree to indemnify FitnessFuelCo against reasonable losses, liabilities, costs and expenses arising directly from your unlawful use of the Website, your fraud, or your material breach of these Terms.

This clause does not apply to the extent that the relevant loss was caused by FitnessFuelCo's own breach, negligence or unlawful conduct.

Nothing in this section limits your rights under the Australian Consumer Law.


21. Suspension or Termination

We may suspend or restrict your access to the Website where reasonably necessary if you materially breach these Terms or use the Website unlawfully.

Termination or suspension of your access to the Website does not affect rights or obligations that arose before the suspension or termination.

Nothing in this section affects your rights as a consumer under applicable law.


22. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down or severed to the extent necessary, without affecting the validity of the remaining provisions.


23. Entire Agreement

These Terms, together with our Privacy Policy and Returns & Refunds Policy, form the terms governing your use of our Website and your purchases from FitnessFuelCo, subject to any additional terms expressly applying to a particular product or transaction.

Nothing in these Terms excludes rights or obligations imposed by law.


24. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

You agree that disputes relating to these Terms are subject to the courts of New South Wales, Australia, to the extent permitted by law.

Nothing in this section prevents you from exercising any rights available to you under applicable consumer protection laws.


25. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, Website, products, services or legal requirements.

The updated version will be published on this page with a revised Last Updated date.

Changes will generally apply from the date they are published and will not retrospectively remove or reduce rights that have already accrued under applicable law.
